McDonough County Board Law & Legal met Nov. 7.

The Law & Legal Committee held its monthly meeting on Monday, November 7, 2022 at 7:00 p.m. The meeting was held at the McDonough County Courthouse, Courtroom 201.
Committee Members present included Committee Chair Joe Erlandson, Vice Chair Ken Durkin, Lee Calvert, Travis Hiel, and Michael Kirby. Members Terra Litchfield, Julie Melvin, and Eric Chapman were absent.
Other persons in attendance were Steve Hess, Dana Walker, Michelle Harman, State’s Attorney Matt Kwacala, Patrick Stout, Tim Lobdell, Dave Schaab, Ric Smart, Deborah Cousins, Sheriff Nick Petitgout, and County Chair Scott Schwerer.
Chair Erlandson called the meeting to order at 7:00 p.m.
Review & Approve October 3, 2022 Minutes
Member Durkin moved with a second by Member Calvert to approve the minutes as submitted. Motion carried on a voice vote.
Waste Management Update
Report received and filed.
Tri-County Recycling
No report.
Veteran’s Assistance and Van Report
Ric Smart gave the report. Eight Veterans were given assistance in October, nine trips were made to Iowa City. Total assistance amounted to $1,705.28.
Sheriff’s Report
Sheriff Nick Petitgout gave the report. They have had an average of 37 inmates, they are holding some for other Counties as well.
Assessor’s Office Update
County Assessor Deborah Cousins gave the report.
CO2 Pipeline Discussion
On October 13th our petition was filed, Knox County and Christian County also filed. A claim was submitted for the attorney’s fees, this will have to go the Finance Committee for approval.
Claims Review and Approval
Member Kirby moved with a second by Member Hiel to approve the claims as submitted. Motion carried on a voice vote.

Executive Session
A motion to enter into Executive Session was made by Member Hiel with a second by Member Durkin to discuss
Litigation under Section 2-C11 of open meetings act at 7:16 p.m.
A motion to exit Executive Session was made by Member Hiel with a second by Member Durkin at 7:29 p.m. No action taken.
Member Hiel made a motion to approve the settlement on Pilat vs. McDonough County Sheriff, Peoria County Case 2022-MR-0000152 moved with a second by Member Durkin.

County Board Chair Comments
County Board Chair Schwerer thanked Lee Calvert for his service to the County as this will be his last Law and Legal meeting.

Member Hiel moved with a second by Member Kirby to adjourn the meeting at 7:33 p.m. Motion carried on a voice vote.
