Judge Marcia Maras, a Cook County judge, ruled on Senate Bill 72, which determines how interest is calculated for awards in personal injury and wrongful death lawsuits, as unconstitutional.
“The judge ruled (the Democrats') new law unconstitutional, setting up a potential ruling by the Illinois Supreme Court,” the Week In Review newsletter said, as posted by Sen. Jil Tracy (R-Quincy) on Facebook.
Vandalia Radio reported Senator Craig Wilcox (R-McHenry) opposed SB72.
“It was interesting that the unconstitutional part was that it created two separate types of litigants,” Wilcox said, according to The Center Square. “That’s how they found it to be unconstitutional.”
According to the newsletter, "The judge stated that the law created different classes of plaintiffs and defendants, by creating larger payouts in personal injury and wrongful death lawsuits compared to other types of cases."
The Week in Review post also highlighted new protections for young victims of sex crimes.
The new law would help protect the privacy rights of victims of child sex crimes by allowing a judge to dismiss disinterested parties from the courtroom when the victim testifies.
This senate bill was first sponsored by Sen. Sally Turner (R-Decatur) in October 2021 and was signed into law on May 27.
