McDonough County Law & Legal Committee Met Feb. 1.

The Law & Legal Committee held its monthly meeting at 7:00 p.m. The meeting was held at the McDonough County Courthouse, Courtroom 201, and via zoom Committee Members present included Committee Chair Joe Erlandson, Vice Chair Ken Durkin, Lee Calvert, Eric Chapman, Travis Hiel, Michael Kirby, Terra Litchfield, Julie Melvin. Other persons in attendance were County Chair Scott Schwerer, Committee Secretary Stacey Alexander, Patrick Stout, Ric Smart, Tim Lobdell, Chief Deputy Adam Cremer, and Dave Schaab.
Chair Erlandson called the meeting to order at 7:00 p.m.
Review & Approve January 4, 2021 Minutes
Member Durkin moved with a second by Member Chapman to approve the minutes as submitted. Motion carried on a voice vote.
Waste Management Update
Report Received and filed.
Tri-County Recycling
Tim Lobdell gave the report.
Veteran’s Assistance and Van Report
Report received and filed. Five Veterans were given assistance in January. Total assistance amounted to $1,263.98.
Sheriff’s Report
Report received and filed.
Assessor’s Office Update
No report.
Review / Discuss Wind Farm Ordinance
Chair Erlandson reported that the Committee received a draft Ordinance on 1/28/21. The Committee went over changes and a light discussion was held. The Committee will receive an updated draft before the next Committee meeting.
Claims Review and Approval
Member Hiel moved with a second by Member Litchfield to approve the claims as submitted. Motion carried on a voice vote.
Other
Chair Erlandson gave the following statement in response to the Public Comment at last month’s Committee Meeting:
“After the public comments & request for an Agenda item offered during the January Meeting, I have been examining the role of Law & Legal Committee. The Policies and Procedures of the McDonough County Board specify that the role of The Law & Legal Committee is to oversee the use of County resources in the following areas: Sheriff’s department, Supervisor of Assessments and GIS, Veteran’s Assistance Commission, and Landfill/Tri-County Waste Management. I have done some additional research on this to further clarify. The State’s Attorney indicates that the Law & Legal Committee does not have any authority to investigate any alleged criminal wrongdoing by any elected official. As a result of this legal opinion, I do not plan to add this request to the Agenda.”

County Board Chair Comments
County Chair Schwerer informed the Committee that the Health Departments Call Center is now open. Chair Schwerer also thanked Member Durkin and Member Erlandson for all their work on The Wind Farm Ordinance.

Member Chapman moved with a second by Member Durkin to adjourn the meeting at 7:46 p.m. Motion carried on a voice vote.
