Fulton County Board met April 28.

Chairman Patrick J. O’Brian called the Special Session meeting to order at 5:30 p.m. in Courtroom 201 at the Fulton County Courthouse in Lewistown, IL.
The Fulton County Clerk called the roll and found the following members present: Quorum was present. (Present-P; Absent-A)

ADDITIONS/DELETIONS TO AGENDA
Member Thompson moved to approve the agenda with a second from Member Hudson. Motion carried by roll call vote (14-0).
PUBLIC REMARKS:
Name: Tracy from Tracy’s Supper Club
Topic: Grant funds
Address: Norris, IL
Tracy discussed the grant that she applied for to sustain the business she took over in 2014. Tracy indicated the business had been closed for 7 years before she purchased. Tracy made the following upgrades and improvements to the business since 2014 a new roof, air conditioners, new heating and some of the flooring.
Tracy stated she tried running the business for three weeks at regular hours and this did not work. Tracy decided to open three nights a week on Wednesday, Friday and Saturday for carryout only as these are the busiest nights for the business.
The business is in good standing with no outstanding taxes and she has not deferred any mortgage payments.

MISC:
a. Discussion/Action: A RESOLUTION IN SUPPORT OF AN APPLICATION FOR COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS TO BE USED FOR THE BENEFIT OF NATIVE TRAILS WINERY, INC.
Member Myetich asked if the grant funds have any requirements that the business needs to be in a municipality or not.
Chairman O’Brian stated this grant is from the State of Illinois for the Community Development Block Grant (CDBG). The county is not loaning the money for this grant from any county funds.
Chairman O’Brian wanted to be transparent that Fulton County is the Grantee and Fulton County would be responsible to repay the grant if the business defaults on the grant.
Justin Jochums stated Chis Jump, City of Canton Attorney have been working on PA (Participation Agreement) to be signed by the business owners with specific terms and conditions. In the agreement the business will need to reopen once the pandemic is over within 60 days or if the business is currently closed, the business would have one year to reopen according to the terms in the agreement.
Justin Jochums State’s Attorney has personal guarantees from the business owners in regards to assets and capital.
The agreement constitutes a valid and binding agreement with business owners and the county.
Member Myetich inquired what the definition of a business being open during the pandemic is? Justin Jochums stated for the business to be considered open it would need to be open normal hours, not just for carry out or curb side business.
Justin Jochums also stated this is a one time grant and the maximum grant is $25,000.00 per business.
Member Murphy moved to approve the Resolution with a second from Member Clark. Motion carried by roll call vote (15-0).
b. Discussion/Action: A RESOLUTION IN SUPPORT OF AN APPLICATION FOR COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS TO BE USED FOR THE BENEFIT OF TRACY’S SUPPER CLUB, INC.
Member Thompson made the statement that Tracy is a neighbor of hers and Thompson is concerned that the state might decline the application for the grant and that all options for assistance have been explored.
Member Myetich moved to approve the Resolution with a second from Member Duquenne. Motion carried by roll call vote (15-0).
Chairman O’Brian stated earlier in the day the public hearing was held regarding the grant money and the first two steps of the process have been completed. State’s Attorney Jochums will complete the remaining details of the grant application process.

Member Hudson made a motion to adjourn the meeting at 5:56pm with a second from Member Clark. The motion carried with all present voting ayes (15-0). The next regular session meeting of the Fulton County Board will be held on May 12, 2020 at 6:30PM, Fulton County Courthouse, Room 201 Lewistown, IL.
