Village of Coal City Planning and Zoning Board met Sept. 17.

Here is the minutes provided by the board:

At 7 p.m. on Monday, September 17, 2018, Chairman Georgette Vota called to order the meeting of the Coal City Planning and Zoning Board in the boardroom of the Village Hall. Roll call-Members Maria Lewis, Jill Breneman, Richard Crotteau, John Hawkinson, Irving DeWald and Amanda Burns. Also in attendance was Matt Fritz, Village administrator.

The minutes of the August 20, 2018 meeting were presented for approval. Hawkinson moved to approve the minutes as written, second by Crotteau. Roll callAyes; Breneman, Crotteau, Vota, Hawkinson, DeWald and Burns. Nays; none. Abstain; Lewis. Motion carried.

ZONING BOARD OF APPEALS PUBLIC HEARING

Variance Request 75 E. Park Street Robert Davis

Clerk Noffsinger swore all those wishing to speak at tonight's meeting. Mr. Fritz presented the variance request for the address of 75 E. Park Street. Mr. Davis owns the property which includes a home and a shed. Off the alley in the backyard Mr. Davis is requesting a variance for the construction of a garage. The discussion of the Board included:

• Garage would be 1156 sq. ft. which exceeds the maximum allowable footage; the structure is 34' x 34' * Structure complies with side yard set-back requirements

• A condition of the variance is a firewall on the west side of the structure

• Height of the structure exceeds the maximum allowable height by 8 inches

• Property is zoned RS-3 and property will be rezoned following construction of the new garage

• Shed on the property will be demolished to make room for the new structure and the home will also be demolished

• Rear set-back is 10 feet but the variance is requesting "0"

• Total allowable lot coverage is exceeded by 14%

• Petitioner will demolish the existing house within six months of the variance

• Rear yard coverage is exceeded by 8%

• Access to the new structure will be from E. Park Street once the house is demolished

• Future plans to rezone property to C-4

• New structure exceeds the allowable accumulative accessory structure Following discussion, Hawkinson moved to approve the requested variance at 75 E. Park Street with the conditions as follows:

Conditions of Variance:

1. Demolish existing house within six months of variance

2. Construction of a firewall on the west side of the new structure Variance:

1. Zero ("O") rear yard setback

2. Total square footage of 1156 sq. ft. exceeds the maximum allowable square footage of 900 sq. ft.

3. Total square footage of all accessory structures is 1100 square feet and the new structure is 1156 square feet

4. Maximum allowable height is 15 feet and the new structure is 15 ft. 8 in.

5. Total allowable coverage is 35% and the new structure exceeds that amount by 14%

6. Rear lot coverage of 35% is exceeded by 8% Second by Lewis. Roll call-Ayes; Lewis, Breneman, Crotteau, Vota, Hawkinson, DeWald and Burns. Nays; none. Motion carried.

Mr. Fritz explained that Mr. Davito is requesting a variance for the construction of an accessory building on his property at 65 W. Second Street. The structure would be 30' x 60' and will exceed the maximum allowable square footage. Discussion included:

• Entrance to structure off the alley

• Lot size is 90' x 183'

• Structure will meet rear and side yard setbacks

• Existing shed will be demolished

• Shed roof or gable end roof comparisons; Board would prefer a gable end roof

• Structure used for storage; lawn equipment, pontoon boat, etc.. Wood frame with siding. May need a height variance

• Public hearing is scheduled for October 15th

• Village will relocate the storm drain

Discussion was held regarding open and pending building permits. Properties discussed were:

1. 1225 E. North Street

• Building permit has expired

• No apparent construction in process

• Owner complied with the requirements per the Agreement

• Mowing liens exist on the property

2. 130 Blackstone

• Mr. Fritz is meeting with owner to discuss plans and options

• Soundproofing is a structural requirement on multi-family

• PUD process will move improvements forward

• Portion of Kankakee Street lie on the owners property

• Entrance to X-Caliber Gymnastics needs to be established

Chairman Vota initiated discussion regarding changing the day of the Planning and Zoning Board meeting to the 2nd & 4th Monday of the month instead of the 1st and 3rd Mondays, or in the alternative, scheduling the meeting on the 1st & 3rd Wednesdays. The Board will consider their options,

The Spinozzi property located at 930 and 950 E. Division Street has been sold. One side of the two commercial space is and will remain rented, but the remaining side is vacant. The house is being renovated for either sale or rent. Questions arose as to inspections and parking.

Crotteau moved to adjourn the meeting, second by DeWald. All signified by saying aye. No one opposed. Motion carried and the meeting was adjourned at 7:56 p.m.
